Terms and Conditions

1. Definitions
1a. Color Peru Personal Travel Advisors S.R.L, from now on is "THE TOUR OPERATOR.”
1b. The customer that from now on requests services and products will be considered "THE TRAVELER.”
1c. All arrangements, intermediation and payments accomplished by The TOUR OPERATOR are considered "SERVICES.”
1d. All food, transportations, excursions, and rooms are considered "TOURIST PRODUCTS.”
1c. All companies and professionals that offer a product or a service are considered "SUPPLIERS.”

2. The Contract’s Bases
2a. These Conditions are exclusive to all of the contracts madden between The TOUR OPERATOR and THE TRAVELER.
2b. All Terms & Conditions present in this page will be considered accepted when THE TRAVELER makes the first deposit to TOUR OPERATOR’s bank account.

3. Method of Reservation
3a. The Quotes are in relation to the products and services that THE TRAVELER request, and continue to be valid for the entire organization and confirmation time of all the services and products for the dates in discussion.
3b. The advance deposits are important to continue with the confirmations of services and products with a minimum of two months before arriving to Peru.

4. Payments
4a. To begin with the bookings, the TOUR OPERATOR needs to have the 50% deposit of the quote.
4b. The final payment must be done within the last month before the arrival to Peru.
4c. The bookings madden within the latter month must be paid completely.

5. Price Policy
5a. All given quotes will be per person, regardless the group number.
5b. The quotes are given in relation to the current date and concerning the date of journey.
5c. The requested services and products will be arranged before the arrival to Peru.
5d. The individual prices of detailed products in the itinerary will not be provided since they are a part of an organized trip.
5e. The quotes will be in relation to the solicited products and services.
5f. Group costs are different to independent quotes.
5g. THE TRAVELER involved in-group trips has the option to travel independently as long as the difference in extra costs are paid before any trip.
5h. The quote is subject to surcharges and it may be affected by last-minute changes such as excessive exchange rates occurs, the increase of hotel costs, transportations, entrance fees, taxes, etc.
5i. The following products will be paid by THE TRAVELER: Airport taxes (Domestic and International flights), customs duties, extra food not included on trip, alcoholic drinks and everything that is not mentioned in the personal quotes.
5j. The passports and documents that will be used in Peru must be the same that was used to book the trip and they must have a validity for the time of trip.
5k. All the Peruvian taxes are included in the quotes.

6. Amendments and Changes
6a. Any amendment or change must be done by e-mail or any document that will be considered as the testimony of the mentioned change.
6b. All the last minute surcharges on services and products will be notified to THE TRAVELER.

7. The Cancellations done by THE TRAVELER
7a. The Travel has to communicate to the Tour Operator as soon as it is possible the cancellation of the trip or part of it.
7b. Any incurred cost for changes and cancellations will be charged to THE TRAVELER when the SUPPLIERS have already charged or are paid for their services and products.

8. The Cancellations done by TOUR OPERATOR
8a. The TOUR OPERATOR cans cancel the organized journey when the deposits are not transferred before the arrival.
8b. In order to preserve THE TRAVELER’s integrity, some organized journeys will be cancelled; in case of floods, fires, THE TRAVELER’s discomfort, civil disturbances, Terrorist Activities, Strikes, Earthquakes, etc.
8c. In any event, THE TOUR OPERATOR will offer alternative services and products to the reserved itinerary.
8d. THE TOUR OPERATOR will be able to collect some extra money to accomplish changes and to give services to the cases mentioned in (b).

9. TOUR OPERATOR Responsibilities and Obligations
9a. The TOUR OPERATOR is THE TRAVELER’s representative before any SUPPLIER.
9b. The TOUR OPERATOR as the representative of THE TRAVELER protects the Traveler’s interests.
9c. The TOUR OPERATOR does all the required investigation to find and work with quality suppliers and professionals.
9d. The TOUR OPERATOR will help THE TRAVELER to solve any problem.
9e. The TOUR OPERATOR will follow the regular and legal way at all time to help THE TRAVELER.
9f. The TOUR OPERATOR will communicate to THE TRAVELER’s family, immediately an accident or death has occurred. It is important for THE TOUR OPERATOR to receive all the correct personal information in advance.
9g. The TOUR OPERATOR will return the recovered quantities not affected by the expenses done before the cancellations.
9h. The TOUR OPERATOR will make the best to help THE TRAVELER to accomplish the last-minute changes to their itinerary.
9i. The TOUR OPERATOR will respond to any complaint or comment filed by THE TRAVELER.
9j. The TOUR OPERATOR is not responsible for injuries, luggage damage, accidents, thefts, losses, delays, and damages generated by third parties.

10. Jurisdiction
10a. All Terms and Conditions abide by the Peruvian laws.
10b. The TOUR OPERATOR and THE TRAVELER subscribe unconditionally and irrevocably to Court’s and Tribunals jurisdiction of Peru.

11. Privacy
11a. Any personal information that is requested by THE TOUR OPERATOR, will be used only to organize the trip.
11b. THE TOUR OPERATOR will not reveal any personal information without THE TRAVELER’s consent.
